Tax when you sell silver in Nevada

No state personal income tax, so no state tax on bullion gains. At the federal level, the IRS treats bullion and most silver coins as collectibles: long-term gains (assets held more than a year) are taxed at your ordinary rate, capped at 28%, and short-term gains as ordinary income.

Selling silver or silver jewelry to a dealer in Nevada

  • License: No general statewide license for secondhand dealers. Cities and counties may license, tax and regulate them, and may ban advertising as a secondhand dealer without a local license (NRS 647.0193, 647.080). A dealer that buys goods with a buy-back agreement must hold a pawnbroker license where local government requires one (NRS 647.019).
  • Hold period: 30 days. Marked or otherwise individually identifiable property may not be removed from the place of business for 30 days after its receipt is reported to police in counties of 700,000 people or more (Clark County), or 15 days in smaller counties (NRS 647.130). A peace officer may also place a written hold (NRS 647.132).
  • What the dealer records: At each purchase, in English: date, the employee, the seller's name, age, driver's license number, street address and general description, a description of the property (watch maker and case numbers, all jewelry inscriptions and marks) and the price paid. Records and goods are open to police inspection (NRS 647.110). Before noon each day the dealer must send the previous day's transactions to the sheriff or chief of police, by mail or by electronic or fax means if police direct (NRS 647.120). Suspected stolen property must be reported at once. No photo, fingerprint or retention period is set for secondhand dealers.
  • What sellers need: Seller must sign a certificate that they have the legal right to sell (NRS 647.120). Dealers commit a misdemeanor if they receive property from a person under 18, or from intoxicated persons or known thieves (NRS 647.140).
  • Who is exempt: Coins, antiques, used books and collectibles are outside the secondhand dealer definition (NRS 647.018), and coins not part of jewelry are exempt from daily reports (NRS 647.120). Certain licensed firearm dealers at short shows are also excluded.
  • The law: Dealers in Junk and Secondhand Materials, NRS chapter 647; secondhand dealer defined in NRS 647.018 (buyers and sellers of metal junk, melted metals or secondhand personal property, other than antiques, used books, coins and collectibles); records NRS 647.110; daily reports NRS 647.120; holds NRS 647.130 and 647.132; offenses NRS 647.140.

Dealers report a customer's sale to the IRS on Form 1099-B only for certain forms and quantities, such as 1-kilo gold bars, 1,000 ounces of silver bars or 25 or more Krugerrands or Maple Leafs; American Eagles and smaller lots are generally not reported. Any business that receives more than $10,000 in cash in one transaction or related transactions files IRS Form 8300. Bring a photo ID when you sell.

Tax and duty information last reviewed October 2026. Rules change — confirm with your dealer or tax authority before a large purchase.
