Tax when you sell silver in Oklahoma

Profits on silver are generally taxed by Oklahoma like other investment gains, under its income tax rules. At the federal level, the IRS treats bullion and most silver coins as collectibles: long-term gains (assets held more than a year) are taxed at your ordinary rate, capped at 28%, and short-term gains as ordinary income.

Gold and silver as money in Oklahoma

SB 862 (2014) established gold and silver coins as legal tender.

Selling silver or silver jewelry to a dealer in Oklahoma

  • License: Businesses with an Oklahoma location that take in or transfer used precious metals (platinum, gold or silver, but not in coin form) or gems must be licensed by the Oklahoma Department of Consumer Credit. Dealer fee $1,125 ($425 investigation, $400 inspection, $300 license); employee license $200 (it was $100 in 2010). One-year term from 1 January. $10,000 bond, plus fingerprints and a photo of each owner or officer. License covers only the listed location. The Department has warned that unlicensed 'gold buying parties' break the law.
  • Hold period: The Act has a hold period, and SB 430 (passed the Senate 43-2 in March 2015, approved 12 May 2015) increased it, but no official source we found states the number of days. A 2016 forum post from a store owner mentions a 10-day hold, but it is not clear whether that is a state or city rule, so it is not used.
  • What the dealer records: Licensees keep books and records for 4 years from the first transaction with each customer or 2 years from the last entry, whichever is later, at an Oklahoma location named to the Department (OAC 160:60-7-1). Detailed record fields not confirmed.
  • Who is exempt: Coins are outside the definition of precious metals for licensing purposes.
  • The law: Precious Metal and Gem Dealer Licensing Act, 59 O.S. 1521 to 1532; rules in Okla. Admin. Code Title 160, chapter 60.

Dealers report a customer's sale to the IRS on Form 1099-B only for certain forms and quantities, such as 1-kilo gold bars, 1,000 ounces of silver bars or 25 or more Krugerrands or Maple Leafs; American Eagles and smaller lots are generally not reported. Any business that receives more than $10,000 in cash in one transaction or related transactions files IRS Form 8300. Bring a photo ID when you sell.

Tax and duty information last reviewed October 2026. Rules change — confirm with your dealer or tax authority before a large purchase.
